1. Service Description
U.CADDIE provides an AI-powered golf GPS application that delivers real-time caddie intelligence, shot simulation, and course strategy recommendations. The Service is intended for personal, informational use only and does not constitute professional golf instruction.
Recommendations are generated using artificial intelligence and course data. Results may vary based on weather conditions, course conditions, and individual player ability.
2. User Accounts
You must be at least 13 years of age to create an account. By creating an account, you agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Accept responsibility for all activity under your account
- Use your account for individual, personal use only
Credential sharing, multi-account creation to circumvent limits, and any form of account abuse may result in immediate termination.
3. Memberships & Payments
U.CADDIE offers various membership tiers with different levels of access and caddie hours. By purchasing a membership, you agree to:
- Pay the applicable fees as described at the time of purchase
- Acknowledge that membership benefits are subject to the terms of your selected tier
- Understand that pre-launch memberships are non-refundable unless otherwise stated
All payments are processed securely through Stripe. We do not store full payment card details on our servers.
4. User-Provided Content
You retain ownership of all information you submit to the Service (club distances, preferences, handicap data, etc.). By submitting content, you grant U.CADDIE a non-exclusive, worldwide, royalty-free license to process that content solely for the purpose of delivering and improving the Service.
5. Intellectual Property
All content, features, and functionality of the Service — including but not limited to software, algorithms, design, text, graphics, and logos — are owned by U.CADDIE and protected by intellectual property laws.
Generated caddie recommendations and course strategies are provided for your personal, non-commercial use. You may not:
- Redistribute, resell, or republish generated content
- Claim authorship of AI-generated recommendations
- Use generated content for commercial purposes without written permission
6. Prohibited Uses
You agree not to:
- Use any automated system (bots, scrapers, crawlers) to access the Service
- Extract data from the Service for building external databases or competing products
- Access any API without official authorization
- Reverse engineer, decompile, or disassemble the Service
- Use any content from the Service as training data or input for any artificial intelligence model, machine learning system, large language model (LLM), or similar technology
- Interfere with or disrupt the integrity or performance of the Service
- Attempt to gain unauthorized access to any part of the Service
Violations may result in immediate account termination and potential legal action.
7. Third-Party Services
The Service integrates with third-party providers including Resend (email), Stripe (payments), and Supabase (infrastructure). Your use of the Service may be subject to the terms and policies of these providers. U.CADDIE is not responsible for third-party practices.
8. SMS Notifications
If you opt in to SMS notifications, you consent to receiving text messages related to your account and the Service. You may unsubscribe at any time by replying “STOP.” Standard carrier messaging rates may apply. Your mobile phone number and SMS opt-in consent will not be shared with or sold to third parties for marketing purposes.
9. Disclaimers
The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied. U.CADDIE does not warrant that:
- The Service will be uninterrupted or error-free
- Caddie recommendations will be accurate or suitable for any particular situation
- GPS data will be precise in all conditions
AI-generated recommendations are not a substitute for professional golf instruction. Use all recommendations at your own discretion.
10. Limitation of Liability
To the maximum extent permitted by law, U.CADDIE shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability shall not exceed the amount you have paid to U.CADDIE in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless U.CADDIE, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
12. Copyright / DMCA
If you believe content on the Service infringes your copyright, please send a written notice to info@ucaddie.com with the subject line “DMCA Takedown Notice” and include:
- Identification of the copyrighted work
- Identification of the infringing material and its location
- Your contact information
- A statement of good-faith belief that the use is not authorized
- Your signature (physical or electronic)
13. Termination
U.CADDIE may suspend or terminate your account at any time, with or without cause or notice. You may terminate your account by contacting us at info@ucaddie.com. Upon termination, your right to use the Service ceases immediately.
14. Governing Law & Dispute Resolution
These Terms shall be governed by the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration under the rules of the American Arbitration Association, except where injunctive or equitable relief is sought.
15. Severability
If any provision of these Terms is found to be unenforceable, that provision shall be limited to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and U.CADDIE regarding your use of the Service.
